Together/Apart Terms & Conditions

By submitting your contribution, you (hereafter referred to as the Contributor) grant a worldwide, non-exclusive, royalty-free license to California State University San Marcos (hereafter referred to as CSUSM) and its agents to preserve, display, reproduce, transmit, publish, republish, and distribute your work as part of Together/Apart: The COVID-19 Community Memory Archive (hereafter referred to as the Archive). This permission includes the right to modify and/or reformat the work as necessary for preservation, publicity, and/or access purposes, and to make it available for educational, research, and promotional purposes outside of the Archive, in perpetuity and in all mediums and media formats hereafter under the conditions specified in these Terms & Conditions.

This license does not authorize CSUSM use of your contribution for profit or commercial use.

Copyright and any other intellectual property right in or to the contribution shall not be transferred by this agreement and shall remain with the Contributor, or the copyright holder if different from the contributor. Other than this limited License, the Contributor or copyright holder retains all rights, title, copyright and other interest in the materials licensed. The copyright holder retains the right to use the submission in future works (such as in articles, videos, or books) as desired by the copyright holder.

Materials submitted must have been created by the Contributor or their designee, wholly original, and shall not be copied from or based upon any other photographic, literary, or other material, except to the extent that such material is in the public domain, or you as Contributor have permission of the copyright owner, or its use is allowed by "Fair Use" as prescribed by the terms of United States copyright law (cf. Title 17 of the U.S. Code). By submitting a contribution, the Contributor certifies that they have obtained permission from the owner(s) of any third party copyright matter included in the submission.

In granting this permission, the Contributor warrants that they are 18 years of age or older and have the full power and authority to consent to this agreement, that the submission does not infringe any existing copyright or contain any libelous matter, nor invade any third party rights of privacy or publicity. The Contributor further agrees to defend and hold harmless California State University San Marcos, its California State University San Marcos Library, its board of trustees, and its officers, employees, and agents against all claims, demands, costs, and expenses including attorney's fees incurred for any and all claims of copyright infringement or any other legal or regulatory course of action arising from the use of contributed materials.

Contributors making submissions to Together/Apart: the COVID-19 Community Memory Archive agree to share their work and waive any privacy rights granted by FERPA or any other law, policy or regulation, with respect to this work, for the purpose of publication by the Library as part of the Archive. In some cases, the Library may need to reach out to faculty, if their IP is included in the submission, to secure their permission. By contributing, student Contributors agree to allow the Library to do so in such cases.

Please note that health information is private. By submitting, the Contributor agrees to make any health information disclosed in the contribution public.

Submitted material must not violate any confidentiality, privacy, security or other laws. Please be aware that all submissions and any information associated with the submissions (email address, descriptive information, etc.) may be provided to federal, state, or local law enforcement or other government agencies pursuant to a lawful subpoena or otherwise as required by law.

Members of the Together/Apart project staff are mandatory reporters under Title IX, and have been given the duty of reporting incidents of sexual harassment/violence or other misconduct to CSUSM's Title IX Coordinator. The Contributor may make an anonymous submission. The Library will not attach any identifiable information (name, email, department) to anonymous contributions ingested into the Archive. No identifying information will appear if anonymous contributions are used in future exhibitions, promotions, or any other outreach regarding Together/Apart. Upon completion of the call for submissions, the Library will delete name, email, and departmental information from anonymous information from our records. If you elect to submit anonymously, this option cannot be undone at a later date.

Together/Apart: The COVID-19 Community Memory Archive has no obligation to use or publish your contribution.

Third-Party Use

CSUSM does not hold copyright of the material in Together/Apart: The COVID-19 Community Memory Archive in the California State University San Marcos Library. As such, CSUSM Library is not positioned to grant licenses to or approve requests from third parties to make use of content in the collection. Contributors may be contacted in the future by the Library if the Library is contacted by a third party for use.

Contact Library Special Collections at archives@csusm.edu for other rights-related questions or, in certain cases, referral to the original Contributor regarding use of his or her content.

Approval Criteria for digital submissions:

  1. Content is related to the COVID-19 pandemic in North San Diego County.
  2. Content is reflective of time period from December 01, 2019 or later. Donations of physical or digital items covering an earlier temporal period will be considered for inclusion into CSUSM’s Special Collections if they meet the department’s Special Collections Collection Development Policy.
  3. Digital surrogates of physical items can be submitted. If desired by the donor and the content meets other approval criteria, the Library may be able to create digital surrogates when campus is again open. This will be considered on a case-by-case basis.
  4. File size of contributed content does not exceed 50MB.
  5. Metadata submitted is deemed to be accurate by the Library.
  6. Users have the right to submit content and submission does not infringe any existing copyright.
  7. Content does not provide personal information of the contributor or any other individual, including addresses, phone numbers, social security numbers, etc.
  8. Content does not endorse any commercial product.
  9. Content does not pose a risk of damage to the network, computers, or servers of CSUSM.

Approval Criteria for Share Your Story and Share Your Faculty Story questionnaires:

  1. Content is related to the COVID-19 pandemic in North San Diego County.
  2. Metadata submitted is deemed to be accurate by the Library.
  3. Users have the right to submit content and submission does not infringe any existing copyright.
  4. Content does not provide personal information of the contributor or any other individual, including addresses, phone numbers, social security numbers, etc.
  5. Content does not endorse any commercial product.
